House Rules

With acceptance of renting this property, this rental agreement and contract is a legally binding agreement between guests and us for the duration of the rental term, for the rental fee, and other good and valuable consideration as described herein.

Booking guest must be 25 years old minimum and must be staying on the premises for the entire length of the reservation.

This is a great getaway spot for families and friends, and we encourage you to have fun, but this is not a party house. We have a close relationship with our neighbors who will contact us if they notice disturbances, if there is excessive noise or gathering larger than our maximum capacity (12 guests). Violation of these rules could result in loss of your deposit and eviction from the property with no refund.

If you are planning to book with us, please make sure your booking platform profile is complete. You will be required to provide a copy of the ID of the renting guest in an email following your booking, your reservation is not complete and susceptible to cancellation should this step not be completed. Additionally, we will need the first and last name of each driver in a vehicle that requires access to the community at least 3 days prior to your arrival date, as we must register them for them to have access through the gate prior to your arrival. Our gated community Pine Mountain Lake (PML) charges a parking pass fee (approximately $40 per car) and issues said permits under the names of said drivers only. Vehicle permits will be collected at the security gate and is valid for up to one week. They accept cash or credit card.
Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.


Occupancy
Guests agree that no more than 12 occupants shall be permitted on the property at any time during your stay without prior authorization from the host. Guests acknowledge they may be fined up to $50 per day for each guest over the limit and possible eviction with no refund.

Cleaning Fee and Security Deposit
A non-refundable cleaning fee is collected as part of your reservation and used to cover the cost associated with normal cleaning of the property and getting it ready for the next guest. It is meant to be used to cover the cost of things like cleaning products, washing linen, paying for cleaner’s labor and the replacement of amenities, it does not cover damaged items such as soiled towels and linen in general due to negligent use. These might need to be deducted from the security deposit.
A refundable $500 security will be collected when an insurance option is not selected during booking and will be refunded in its entirety within 14 days after your stay assuming our home is left in good condition with no damage and no fines applied.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the units except for the beach towels provided. These can be taken to and from the lake’s beach but must be returned. Missing or damaged items beyond normal wear and tear might be deducted from the deposit at the discretion of the host.

Security Camera
We have placed security cameras outside the property to exclusively monitor the perimeter. It is automatically triggered by movement in its field of view. The cameras do not point inside the house. Although PML is generally a very safe area, the cameras are there for the safety of our home and for your security and should not be tampered with, moved or covered. We also have the option to talk with you via the Ring if you have trouble entering our home. There is a minut noise monitor that will notify you and us of excessive sound levels, it does not record nor have listening capabilities.

Furniture
Please do not move any piece of furniture from their set place. Indoor furniture should not be used outdoors, including but not limited to dining room chairs, tables, etc. Guests agree to keep furniture in place.

Storage areas and Recreational equipment
We have a few storage areas in the home that are locked-out from guests, in general, the areas labeled as “Storage”, “Closet”, “Boiler room” hold our linen and other turnover supplies for our cleaners as well as home equipment and tools. They are not to be accessed by guests which is why they are locked. The same goes for the kayaks and stand-up paddle equipment, the community offers a rental program should you wish to practice such activities.

Smoking
All forms of smoking, e-cigarretes, vaping or burning anything inside, including candles, incense, or illegal substances are prohibited inside the house. Kindly smoke outside and at least 25 ft away from windows, doors and decks. We are in a wildfire prone area; therefore, extra precautions must be taken. Guest shall be responsible for any damage and repairs incurred due to smoking such as burn marks, ashes removal, ozone treatment and deep cleaning procedures.

Pets
We wish to provide luxurious and comfortable accommodations to all our guests, the presence of pets would limit our ability to do so effectively, because of this, there are no pets allowed in our property. A $50 per day fine plus a deep cleaning fee will apply if this rule is violated. Guests acknowledge and will abide by this rule.

Condition and Use of Property
Our home is provided in “as-is” condition. Hosts shall use its best efforts to ensure operation of all amenities in the property such as internet access, electrical, water supply, etc. Host shall not be held responsible for such items fail to work but will make every effort to correct any issues as quickly as possible. WiFi and streaming TV services are provided as a free service and may occasionally experience outages that are beyond our control due to the area being heavily forested, occasionally a thunderstorm may cause a power outage as trees are downed. You may message the owner so that the outage can be reported.
Guests shall use property for residential purposes only and in a careful manner to prevent any damage or loss to the property. Guests shall keep the property in sanitary condition. Guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall the guests use the property for immoral, offensive, or unlawful purposes.

Water and Sewer
The sewer system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the system, you could be charged damages for the repairs in addition to waiving your security deposit.

Maintenance
Guests agree to report any equipment failure to hosts immediately. Host has the right to allow technicians to enter the home during your stay if repairs are needed and will provide 48-hour notice for non-emergency repair. The host has a right to allow technicians to enter the home immediately without notice if emergency repairs are needed.

Fireplaces and fire pit
The fireplaces within the home are very efficient vented propane gas log fired firebox with convection function. Please do not touch the safety glass or put in contact to it any combustible. At the outdoor firepit area, exercise extreme caution when using the fire pit, it is fueled by a portable propane tank, thus no other combustible material shall be burned or cooked in the flame area, there is dry vegetation that could ignite and cause a hazardous condition. The pathway to it requires a walk up an undeveloped hill with a steep side drop towards the rear deck. If you have concerns with walking on dirt, difficulty maintaining equilibrium and to stay clear of edges, adults with special mobility needs, or small children, please use at your own risk.

Garbage
Garbage should not be left out overnight, only within the trash bin containers provided for your convenience.

PMLA Rules and Regulations
All Residents of PMLA are required to follow PMLA Rules & Regulations. The following are some “common violations.” Please do your part to maintain a harmonious environment for all to enjoy.

Parking and Vehicle Restrictions:
You may not:
1. Park any vehicle, trailer or camper on the street (including shoulders), nor at the marina during weekends and holidays
2. Operate any unlicensed vehicle on the roadways (dirt bikes, go-carts, quads, etc)
3. Exceed the posted speed limit or drive in a reckless manner
4. Follow another through a security gate or allow others to follow you through a security gate

Personal Conduct:
You may not:
1. Allow loud music or other unreasonable noise, during community quiet time (after 10pm and before 7am). The garage door has been disabled and should always remain CLOSED to limit noise propagation
2. Use skateboards, rollerblades, or scooters on PML streets or the Common Area
3. Light any fireworks (banned by Tuolumne County year-round)
4. Shoot any kind of gun or arrow

Construction
Construction at areas surrounding our home is out of our control. We do not offer discounts or refunds for construction noise or disturbances. If there is extensive noise beyond normal working hours, we will attempt to contact the onsite construction manager as they are bound by the same noise curfew requirements

Risk of Loss and Indemnification
Guests agree that all personal property, personal affects, and other items brought into our home by guests shall be the sole risk of the guests regarding theft, damage, destruction, or other loss. Host shall not be responsible or liable for them for any reason whatsoever. Guests also agree to indemnify and hold harmless hosts, property managers, contractors, or staff from and against costs, damages, liabilities, claims, legal fees, attorney fees, and other actions, incurred by guests due to any claims relating to destruction of property or injury of persons or loss of life sustained by guest(s) in or about the property in all such cases. If there is reasonable belief that there is imminent danger to any person or to the property, the host shall enter or allow someone to enter the property without advance notice.

Release
Guests waive and release any claims against host for any injuries or death that may be sustained by guest(s) on, near, or adjacent to the property, including such facilities, activities, or amenities such as, but not limited to the sauna, lake, fire pit, wildlife, etc. Guests agree to use all facilities and amenities entirely at the guests’ own initiative, risk, and responsibility.

Storms:
No refunds will be given for storms, weather conditions, air quality, or other conditions which are beyond our control. For such eventualities, we recommend purchasing travelers’ insurance.
Mountain roads can be curvy and steep. We do not refund due to road conditions.

Unavailability of Property
In the unlikely event our home is not available for use during the rental term, due to reasons, events, or circumstances beyond control of the host, the host will apply due diligence and good faith efforts to assist in locating a replacement property that equals or exceeds the property with respect to occupancy capacity, location, and value that meets the guests’ satisfaction. If such replacement cannot be found or made available, host shall immediately return all payments made by guests, whereupon this agreement shall be immediately terminated. Guests and host shall have no further obligations or liabilities in any manner pertaining to this agreement.

Additional Terms of the Rental Agreement
Rates, taxes, policies, and PML amenity rates are subject to change without notice. Host does not manage Pine Mountain Lake Association (PMLA) and does not have control over closed facilities, improvements, wildlife, and pest control. Host shall do their best to provide advanced notice when possible.

This agreement contains the entire agreement between the parties regarding the rental of the property, and any changes, amendments, or modifications shall be void unless the same are in writing and agreed upon by both parties. The agreement shall be governed by the laws of the state of California. The words “guests” shall include all occupants of the property and their heirs, successors, and representatives. If any provision herein is held invalid, the remainder of the agreement shall not be affected.

If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in.
After that, 50% refund up to 7 days before check-in.
